Selling an AS IS property to a buyer

Some homeowners list their property for sale exactly as it is—flaws and all. However, from a buyer’s perspective, this may be interpreted as an attempt by the seller to “get rid” of the property at any cost.

The term “As Is” refers to selling a property in its current condition, including any existing defects. In doing so, the seller essentially absolves themselves of responsibility for repairs or compensation for any issues that arise from the property’s condition.

What Selling a Property “As Is” Does NOT Mean:

  • It does not exempt the seller from fully disclosing known defects. By law, all questions regarding the property’s condition must be answered truthfully.
  • It does not allow the seller to deliberately conceal relevant information about the property.
  • A real estate advisor assisting in the sale must also provide full transparency when answering buyers’ questions about the property’s condition.
  • A real estate attorney handling the transaction will typically include a clause in the sales contract stating that the property is being sold “As Is,” explicitly describing its condition. This protects the seller from potential legal claims after the sale.

How Buyers Perceive an “As Is” Sale

From a buyer’s perspective, an “As Is” listing may immediately signal that the property has significant issues—big or small. This perception gives buyers an advantage when negotiating the price.

In most cases, buyers will view an “As Is” property as flawed and use this as leverage to lower the asking price.

Why Do Sellers List a Property “As Is”?

There are several reasons a real estate consultant may market a property in this way:

  1. Significant Issues: The property may have major defects that the owner is unwilling to invest in repairing. These could range from minor cosmetic fixes to extensive renovations.
  2. Lack of Time or Resources: The homeowner may lack the time, funds, or willingness to upgrade the property before selling. They simply want to sell it as quickly as possible.
  3. Foreclosure or Liquidation: In cases of foreclosure or financial distress, the property may be listed “As Is” out of necessity rather than choice.

Additionally, if a buyer conducts a professional home inspection, they may use any serious findings as grounds for further price negotiation.

A Seller’s Perspective on “As Is” Listings

In many cases, homeowners sell “As Is” not because the property is defective but simply because they choose not to invest in upgrades before listing. While this is a legitimate decision, sellers must consider that buyers may assume the worst and immediately question the home’s condition.

A Better Alternative to Selling “As Is”

Rather than labeling the property “As Is,” a more effective strategy is proper pricing—setting the asking price in line with comparable properties in similar condition. This prevents buyers from approaching the deal with skepticism and reduces the likelihood of aggressive price negotiations.

If the home has significant operational defects, the homeowner should weigh the option of making necessary repairs versus lowering the asking price. Ultimately, the decision rests with the seller. Selling a property in its current condition is easier in a seller’s market, where buyers have fewer options and are more willing to compromise.

When Is Selling “As Is” the Right Choice?

Listing a home “As Is” may be suitable when the owner lacks the financial resources or willingness to make repairs. However, buyers often see such properties as bargain opportunities, which can ultimately hinder the ability to maximize the sale price.
